(WICHITA, Kan.) — Update: Wichita police say a homeowner was in his right to fire a shot at a man who broke into his home.  That shot didn't hit the suspect, instead, it struck a tree.

Wichita police are looking for a home burglary suspect.  The burglar broke into a home in the 600 block of N. Brookfield near Central and Woodlawn late Tuesday evening.

Police say the 64 year-old homeowner was sitting in his living room with the patio door open.  The homeowner says a man with a gun entered and demanded property.  The homeowner grabbed his own gun and fired one shot towards the intruder.  Police say the shot hit a tree.  The suspect was not injured.

Police say the homeowner was justified in firing his gun because he was fearful of his life.  No charges will be filed in the case.
