(WICHITA, Kan.) — A Hutchinson man is charged with aggravated battery in the toddler's case.

On Monday July 18, officers responded to a house in Hutchinson for a medical condition involving a 2-year-old girl.  The girl was transported to Promise Regional Medical Center and later to Via Christi St. Francis. The 2-year-old victim remains in critical condition in Pediatric ICU from injuries to the head.

Hutchinson police say there is information that Toby Hippen is responsible for the injuries. On Thursday July 21, a warrant was issued for Hippen on charges of aggravated battery and he was arrested.

Hippen has been formally charged with one count of aggravated battery.  His next court appearance is August 9th at 8:15am for a status hearing.

Hippen is the brother of Brigit Hippen, a Hutchinson woman who will stand trial in the death of her 3-month-old baby.  Her trial is scheduled for August 23rd.

Prrosecutors say Brigit Hippen's baby died of hyperthermia in February 2010.  They say the 19-year-old left her in a bassinet near a hairdryer and then fell asleep.  When she awoke several hours later, the baby was dead.  Doctors say the baby's core temperature was 108 degrees.
