Store shooting suspect makes first appearance

(WICHITA,Kan) — Police say he opened fire at a local clothing store on Monday…on Wednesday Jake Jacobs made his first appearance in court. The 27-year-old is charged with four counts of aggravated assault.

A lot of questions remain in the case - specifically, why police believe Jacobs opened fire in Burlington Coat Factory Monday morning.

Authorities have said it started after a security guard approached Jacobs asking if he was going to pay for a soda pop he was drinking.

Police say he fired one shot at the security guard and pointed his gun at three others. The security guard...customers and employees were not hurt.

Now Jacobs’ attorney claims officers injured his client.

"What I can say is that I am a little disturbed about what I heard that he only had minor injuries."

Attorney Mark Schoenhofer claims police injured Jacobs while arresting him.

"He suffered a broken jaw...several teeth were kicked out of his lower jaw area."

Wichita Deputy Chief Tom Stolz says officers needed to use a level of force to make the arrest. He denies officers kicked Jacobs several times.

Stolz says he called Jacobs injuries minor because he was released from the hospital the same day.

About 20 customers and employees were in the store when the shooting happened. Some of them told police that Jacobs was acting strangely before the shots were fired.

The judge has signed a protective order forbidding Jacobs from contacting witnesses in the case.
