Hospice Care of Kansas and its parent company Voyager HospiceCare Inc., have agreed to pay a $6.1 million settlement. The agreement resolves allegations the companies violated the False Claims Act by submitting claims to the Medicare program for ineligible hospice services. The deal resultED from a whistleblower lawsuit first filed more than six years ago by Beverly Landis, a Hospice Care of Kansas nurse. Landis will receive $1.34 million.     The government alleged the companies submitted false Medicare claims between 2004 and 2008 for patients who did not have prognoses of six months or less to live - a requirement for the benefits.

The decision to start hospice care is not an easy one to make. Beginning hospice care in a timely manner is an important key to its success. Even though the decision is not an easy one. Many hospice patients are ambulatory and only require occasional assistance at the time they are admitted into the hospice program. The hospice benefit as approved by Medicare is not limited in terms of time. Patients and families express more satisfaction with hospice care when services start earlier.

Medicare, Medicaid, and virtually all managed care or fee-for-service plans cover hospice services. The expense of healthcare at the end of life can potentially be a burden, but hospice care can greatly reduce that financial burden. The Medicare Hospice Benefit is good news! Medicare offers a hospice election that is separate from its other reimbursement structures. All services, medications, treatments, respite care, supplies and equipment related to the terminal diagnosis and part of a hospice plan of care are fully covered.
